CHAPTER 5-20 - WINTER GAS SERVICE TERMINATION

5-20-010  Definitions.

     For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meaning given herein. The word “shall” is always mandatory and not merely directory.

     (1)     “City” means the City of Chicago, Illinois.

     (2)     “Company” means the person who engages in the business of furnishing or supplying gas for consumption in the city to any residential consumer.

     (3)     “Council” means the city council of the City of Chicago, Illinois.

     (4)     “Person” is any person, firm, partnership, association, corporation, company or organization of any kind.

5-20-020  Purpose.

     The purpose of this chapter is to protect and promote the health, safety and welfare of the residents of the city; and establishes the rights and obligations of the company and residential consumers concerning the provision and use of gas for heating during the winter months.

5-20-030  Termination ban.

     Any person engaged in the furnishing or supplying of gas for consumption in the city to any residential consumer shall be prohibited from terminating services or discontinuing the supply of gas to any residential consumer during the calendar months of November, December, January, February and March.

     Any person engaged in the furnishing or supplying of gas for consumption in the city to any master-metered residential consumer shall be prohibited from terminating services or discontinuing the supply of gas to any master-metered residential building during the months of November, December, January, February and March.

5-20-040  Reconnection.

     Any person engaged in the furnishing or supplying of gas for consumption in the city to any residential consumer shall be required during the calendar months of November, December, January, February and March, to reconnect and institute services or reinstate the supply of gas to those residential consumers who tender 25 percent of their outstanding gas bill or $200.00, whichever is less, to the company, or any lesser amount agreed upon by the company and the consumer.

     Any person engaged in the furnishing or supplying of gas for consumption in the city to any master-metered residential consumer shall be required, during the calendar months of November, December, January, February and March, to reconnect and reinstitute services or reinstitute the supply of gas to those master- metered residential buildings whose owner(s) tender 25 percent of their outstanding gas bill to the company or any lesser amount agreed upon by the company and owner(s) involved.

5-20-050  Enforcement.

     The law department of the city may file suit in the name of the city against any person to restrain and prevent any violation of this chapter.

5-20-060  Penalties.

     Any person who violates, or who impedes the enforcement, of any of the sections of this chapter shall upon conviction thereof be punished by a fine of not less than $100.00 nor more than $500.00. For purposes of assessing penalties under this section, a separate and distinct offense shall be deemed to have been committed for each and every day on which any person shall be guilty of such violation.
